Welcome to Dom's Illustrations & Photography, an online art gallery and marketplace. These Terms and Conditions govern your use of our website, the purchase of prints, and the commissioning of original artwork. By accessing or using our site, you agree to be bound by these terms. If you do not agree with any part of these terms, you must not use our website.
Intellectual Property
All artwork, images, designs, and content on this website are the intellectual property of the respective artists and Dom's Illustrations & Photography, and are protected by copyright law.
• Prints: When you purchase a print, you are purchasing a physical product. You do not acquire the copyright or any other intellectual property rights to the artwork. Reproduction, redistribution, or commercial use of the artwork is strictly prohibited without the artist's express written permission.
• Commissions: The artist retains all intellectual property rights to commissioned artwork, including the right to display the work in their portfolio and to create prints or other merchandise from the design, unless otherwise agreed upon in writing.
Purchases
Prints
• All prices for prints are listed in USD. Prices are subject to change without notice.
• We make every effort to display the colors and details of our prints accurately, but we cannot guarantee that your device's display will accurately reflect the actual colors of the product.
• All sales are final. We do not offer refunds or exchanges unless an item is damaged during shipping. If a print arrives damaged, you must contact us at Dom.6.smith@gmail.com with photos of the damage within 15 days of delivery.
Commissions
• Process: The commissioning process begins with a detailed discussion of the client’s request, including the subject matter, size, medium, and timeline. The artist will provide a quote based on this discussion.
• Payment: A non-refundable deposit of 25% is required to begin work on a commission. The remaining balance is due upon completion and before shipping.
• Revisions: The artist will provide updates during the creation process. Minor revisions can be made at the artist's discretion. Significant changes requested after work has begun may incur additional fees.
• Cancellation: If a client cancels a commission after work has begun, the initial deposit will be forfeited.
• Delivery: Once the final payment is received, the artwork will be shipped. The client is responsible for all shipping and handling fees.
Shipping and Delivery
• We ship to the US region.
• Shipping costs are calculated at checkout and vary based on the destination and the size of the order.
• We are not responsible for delays in shipping or delivery caused by the shipping carrier, customs, or other factors beyond our control.
• The client is responsible for any customs fees, duties, or taxes incurred upon delivery.
User Conduct
You agree not to use this website for any unlawful purpose or in any way that could damage the site, interfere with its operation, or violate the rights of others. This includes, but is not limited to, unauthorized use of our content, spamming, and harassment.
Limitation of Liability
Dom's Illustrations & Photography and its artists shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use of, or inability to use, our website or products.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Ohio/US. Any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts of Ohio/US.
Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Your continued use of the site after any changes indicates your acceptance of the new terms.

All sales of art prints are final, subject only to the following conditions regarding damage or incorrect items.
1. Damaged or Defective Prints
If your print arrives damaged due to shipping or is defective (e.g., printing errors, smudges), we are happy to offer a replacement or a full refund.
Reporting Period: You must notify us within 15 days of receiving your order.
Required Documentation: Please email us at dom.6.smith@gmail.com with your order number and clear photographic evidence of the damage to both the product and the original packaging. This is necessary for us to file a claim with the shipping carrier.
Resolution: Upon review, we will offer you a choice between:
A full refund (including original shipping costs), OR
A replacement print, shipped at no extra cost to you.
2. Incorrect Item Received
If you receive a print that is different from what you ordered, please contact us immediately. We will arrange for the correct item to be shipped to you and provide instructions for the return of the incorrect item at our expense.
3. No Refunds for Change of Mind
We do not offer refunds or exchanges if you simply change your mind, decide you no longer want the print, or dislike the color/size after the item has been shipped. We encourage customers to review the product descriptions and dimensions carefully before purchase.
Part 2: Custom Commissions (Unique Artwork)
Due to the personalized nature of commissioned artwork, our refund policy is designed to protect the artist's time, effort, and materials.
1. Commission Deposits (Non-Refundable)
A non-refundable deposit of 25% of the total commission price is required to secure your spot and for the artist to begin work (including planning, sketching, and material purchases).
If the Client Cancels: If the client decides to cancel the commission after the deposit has been paid, the deposit is forfeited to compensate the artist for time and materials used up to that point.
If the Artist Cancels: In the rare event the artist is unable to complete the commission due to unforeseen circumstances, the full deposit will be returned to the client.
2. Progress and Approval
We will provide various progress updates (e.g., a sketch phase, a color preview) for your review and approval.
If the client is dissatisfied with the work, we will attempt to resolve the issue with one set of revisions at that stage.
If, after the revision and before the final payment, the client remains completely unsatisfied and does not wish to proceed, the artist will retain the initial non-refundable deposit.
3. Final Payment and Completion
The final balance is due upon the completion of the artwork and before shipping.
Once the client approves the final photograph/scan of the completed artwork and the final payment is made, no refunds will be issued. This approval serves as final acceptance of the artwork.
Damage During Shipping: If a commissioned piece arrives damaged, the policy is the same as for prints (see Part 1, Section 1), and we will work with you to arrange repair, replacement (where possible), or a refund depending on the extent of the damage.
